Under Section 154 of the Code of Criminal Procedure (CrPC) in India, police are legally obligated to register an FIR when they receive information about a cognizable offense, and refusing to register an FIR for such offenses is a punishable offense for the police officer.

The FIR must contain essential details including: the date, time, and place of the offense; description of the offense and circumstances under which it occurred; names and descriptions of suspects if known; details of the complainant (the person reporting the crime); and signatures of the complainant and the police officer recording it. A copy of the FIR must be provided free of charge to the complainant. The importance of FIR lies in its role as a legal document that can be used as evidence in court, establishes official record of when and what was reported, sets the investigation process in motion, and provides legal protection to the complainant. Citizens have the right to: get an FIR registered for cognizable offenses, receive a free copy of the registered FIR, approach higher police authorities or magistrates if police refuse to register FIR, and lodge an FIR at any police station regardless of jurisdiction (though it may be transferred to the appropriate station).
